2018: Current Florida Kratom Laws

Currently, as of January 2018, Kratom is 100% legal to buy and use in the state of Florida—everywhere except Sarasota. There have been several attempts in Florida to illegalize the product, but they were unsuccessful. More specifically, there is the ongoing debate as to whether or not to categorize the item as a controlled substance.

In March of 2017, Sarasota Democratic Representative Kristin Jacobs proposed House Bill 183 (HB 183: Controlled Substances), proposing that Mitragynine & 7-Hydroxymitragynine (Kratom alkaloids) should be added to Florida’s controlled substances list. The proposal was postponed and withdrawn from consideration in May of 2017. In October of 2017, the bill was recorded as dead in the Criminal Justice subcommittee. This wasn’t the first time the attempt was made, such as House Bill 073 (HB 73: Controlled Substances) in 2016.

Federal Impacts on Florida Kratom Laws

When it comes to federal enforcement, the Drug Enforcement Agency (DEA) can have an impact on laws covering not only Florida but all US states. This would have an impact on legal usage in the state of Florida. Currently, the DEA wants to make the drug illegal, specifying that large amounts can perform to the equivalent of the opioid known as heroin.

Kratom is currently served as an herbal supplement in Florida at many local kava bars. Kava is a traditional, South Pacific Polynesian root drink that is claimed to deliver euphoric experiences. In 2015, Florida Department of Law Enforcement’s (FDLE’s) Kratom review involved the impact of the herb within the state and they determined that it does not pose any significant risks to the safety or welfare of residents of Florida. By significant, one can interpret that phrase as not dangerously harmful to citizens using it or for those around someone who does.

Of course, using Kratom can still cause harm in massive quantities, but that is for the user to decide. In reality, almost any drug or herb can be harmful in large doses, just like soda and coffee can harm the liver or kidneys over time depending on usage.

Broward County is one of the leading areas in Florida for opioid addictions. However, Kratom has been used in the county by numerous residents to break free from their opioid habit, which is great news and it could reduce the abuse numbers over time. However, passing legislation that outlaws the herb would leave Broward County with a busy enforcement schedule and increasing opioid abusers.

Currently, local law enforcement agencies do not have any sort of enforcement or restrictions on the use of Kratom, except Sarasota of course, where they have their own local laws forbidding its use and its production.
